Claim process
Application Level
- Up to 9 months for determination
- 60 days to file an appeal if desired.
Reconsideration Level
- Up to 9 months for redetermination
- 60 days to file an appeal if desired.
Hearing Level
- Over a year for a hearing date
- 60 days to file an appeal if desired.
Appeals Council Level
- Up to 2 years for a decision or action
- 60 days to file a civil action in Federal District Court
Federal District Court Level
- Up to 2 years for a judgment/decision
- 60 days to file an appeal with the Ninth Circuit Court of Appeals
Ninth Circuit Court of Appeals Level
- 2-3 years for a judgment/decision
- Last forum of appeal for social security disability cases except for rare cases which may go to the United States Supreme Court
The Social Security disability claims
The Social Security Administration offers two particular disability benefits. You may apply if you fall under any of the following:
- Disability Insurance Benefits (DIB)
- Supplemental Security Income (SSI)

Disability Insurance Benefits (DIB)
- AkA: Tittle II and Social Security Disability Insurance (SSDI)
- For claimants who become disabled before full retirement age
- Must have worked a minimum of 15 consecutive years and paid into Social Security throughout that time
- Disability must be expected to last at least one years and can only apply within six months after termination of employment
Supplemental Security Income (SSI)
- AKA: Tittle XVI
- For claimants with limited income
- Can apply at any time if disabled
- Must qualify financially
Preparation Before Consulting a Lawyer

- Call if you have a denial
- If your deadline is running short of time, file the appeal and protect your deadline. You should contact us after you file the appeal.
- Be prepared – have your claim’s general information ready ( type of denial ,date of denial, and referral source ).
- Be sure you continue to receive medical treatment.
- If you have general Social Security questions, you may contact your local social security office.
- Throughout the process, we ask that you, please remain patient. the procedures can be very lengthy and frustrating
